It describes the prior objectives and the measures for their acquirement, considered by the Slovak Republic as key issues to be taken in the 2006 - 2008 period, along the road towards the objective of preventing and eliminating poverty and social exclusion. The report focuses on topics of social inclusion, pensions, and health and long-term cares. The aim of the report is to provide balanced information complex on the main priorities and measures applied in the Slovak Republic. The common target of the report is to: Promote social cohesion, equality among men and women and to support equal opportunities for all through protection systems and social inclusion policies. The social inclusion policy is complex as well as multidimensional and requires coordinated efforts of several policies. Therefore it is important that it integrates political measures across several fields for instance the labour market, social protection and assistance, education, housing, public services, equality of opportunities, etc. The essential measures preventing and/or mitigating social exclusion and poverty are: support of earnings (mainly of families with children) support of access to employment education and integration in the labour market support of income and development of human capital access to public services Steps realised in the family-supporting framework, targeted to fulfillment of the essential function of the family and childrens protection system are unavoidable components of prevention and elimination of exclusion and poverty. The most important factor of the risk of poverty in the Slovak Republic is unemployment rate, which has a declining tendency. Poverty is a problematic issue because it is reproduced from one generation to another. Lives of children are considerably influenced by the circumstances of the lives of their parents, as well as their education and income. There is a very significant relation between performance of children at school and their social and economic environment in Slovak conditions. That is why it is very important to support the access to education of children from low-income families. They include incentives of school attendance on the basis of the school subventions system and social scholarships for children from their pre-school education up to universities. The pro-active measures on the labour market enable covering of expenses for parents who care for children before the beginning of the obligatory school attendance like the introduction of tax bonus for working parent for every child; increased non-taxable part of the tax base for the taxpayer and for his or her spouse (19.2 times the subsistence). Moreover, parents can receive their parent benefits even if they work. Besides the employment, the analyses in the Slovak Republic identified the following variables with highly positive correlation with poverty: education and place of residence of the family or one person (region and urban environment). Its because of the wage differentation has a growing tendency among regions in the Slovak Republic. The main groups that are endangered by poverty and social exclusion are: incomplete families with children the families with three and more children children and youth under 17 years of age the group of age between 18 - 24 years unemployed mainly long-term unemployed persons, people suffering from health impairments, homeless persons, persons released from prisons, drug and other addicts, and marginalised Roma communities, which are supported by the complex solutions of the problems in areas like education, employment, housing, health according to the following prior documents. Their main gestor is mandatary of the government dealing with the Roma communities. National Action Plan related to the decade of the Roma community integration supported by the government of the Slovak Republic Medium-term conception of the nationality minorities development in the Slovak Rebublic (SOLIDARITY-INTEGRITY-INCLUSION) Conception of the Roma Children and Young People Integrated Education including Secondary and University Education Development www.romovia.vlada.gov.sk Long-term conception of housing for marginalised groups of inhabitants and the model of its financing MOLSAF SR supports the realization of the community social work program, which is a part of the complex development of the Roma communities. The target groups are especially the inhabitants of the Roma communities that means socially excluded and geographically segregated communities. Social workers provide consultancy, cooperate with the community and Office of Labour, Social Affairs and Family during the improvement of living conditions in the family. They help with the risk minimization of the children living in socially disadvantaged environment. The task of social workers is to prepare the community on further activities within the Roma community program. Terrain social workers attended the introductory and continuous education activities and trainings. The program is managed by the Fund of Social Development and financed by the grants of the Offices of Labour, Social Affairs and Family. These grants are provided to communities, which are the employers of terrain social workers. The challenge of the next period is to promote the social inclusion of vulnerable groups of population in particular Marginalised Roma communities through support of public awareness and fight against discrimination. In the part of social and legal protection of children at special risk priority are political objectives of the next period which have been determined as follows below: to reduce poverty of children and to resolve the inter-generation reproduction of poverty by preventive measures and by support of families with children to increase inclusion and to fight against discrimination of endangered population groups by supporting the availability of public services, developing local solutions and increasing the participation of excluded groups in the life of society to improve access to the labour market and to increase employment and employability of the population groups endangered with exclusion to strengthen management, implementation and monitoring of political measures accepted at national, regional and local levels The Slovak Republic will also orient effort to improve the implementation of legislation in the social and legal protection of children, social guardianship and related legislation. In the concrete, it means to support: prevention, rehabilitation of the original family, and the assurance of a proper substitute parental environment for a child who cannot be provided with upbringing in his/her own family. The social and legal protection of children at risk of social exclusion (mainly disabled children, children living in/leaving institutions, children in foster care, children who are (potential) victims of abuse and violence, children who have contact with the criminal justice system, children at risk of substance abuse and children of migrant/ethnic minority backgrounds) in Slovakia is regulated by independent Act No. 305/2005 on the social legal protection of children and social guardianship, which entered into effect a relatively short time ago on September 1, 2005. The latest information about this act is that the MOLSAF SR prepares its novelisation, which is in the legislative process. Social and legal protection of children and social guardianship (SLPC and SG) is a package of measures which ensure the protection of the child that is necessary for the child's welfare and that respects the best interest of the child, in accordance with the international convention1, the education and the general development of the child in its natural environment and an alternative environment for a child that cannot be raised in the child's own family. it means that SLPC and SG measures are provided for every child regardles of childs origin. That is why we do not have any special SLPC and SG measures for Roma children. Ialso would like to point out that there are no street chidren, who live on the street without any care. It is besause of obligation 27, Act 305 as follows bellow: Where the child finds herself/himself without any care, or where the child's life, health or favourable mental, physical and social development has been seriously jeopardised, or disturbed, the SLPC and SG authority shall be obliged forthwith: to file an application with the court to issue a preliminary injunction, subject to a special regulation, ensure that the basic living needs of the child are met and the child is admitted to a childrens home. In the application for the issue of the preliminary injunction the SLPC and SG authority shall state the natural person or the legal entity in whose custody it proposes to temporarily entrust the child, while taking regard of the maintenance of the family and kinship relations of the child. With a view to varying the family circumstances of the child, that was placed in temporary custody of a natural person or a legal person by a preliminary injunction of the court, the SLPC and SG authority shall, in cooperation particularly with the municipality and the accredited entity, implement measures to ensure the regulating of the family circumstances of the child. Where the measures, subject to paragraph 4, have failed to produce regulation of the family circumstances of the child, the SLPC and SG authority shall proceed pursuant to 33 to 44 - provision for an alternative family environment. When adopting SLPC and SG measures in all fields, competent bodies always give preference to the best interests of the child. For example, when implementing SLPC and SG measures for minors, the social legal protection and social guardianship bodies (Act No. 305/2005 on social legal protection and social guardianship) act pursuant to the valid intrastate legal regulations and international conventions in the field of the protection of childrens rights. Based on these documents, the protection of childrens rights and interests guaranteed by law is considered as the most significant aspect in decision-making. In selecting and applying SLPC and SG measures, priority is given to those SLPC and SG measures, which provide care and general development of children in their natural family environment or in alternative family environment. SLPC and SG measures are taken particularly through social work by using the methods, techniques and procedures corresponding to the knowledge of social sciences and the state and development of the socio-pathological phenomena of the society. In the concrete, these measures are provisioned mainly by: the prevention of crisis situations development in the family and the reduction or elimination of negative effects measures for the protection of life, health and favourable mental, physical and social development of the child provision for alternative family environment In the case of children who may not be raised by their own parents due to various reasons, such as children in foster care, contributions for the support of foster care of children are except SLPC and SG measures also, provided in the form of regular monthly contributions (ongoing contributions to children, ongoing contributions to foster parents and special ongoing contributions to foster parents) and one-time contributions in the event of the beginning and termination of the foster care. administration of measures in the facility Children in institutional care receive contributions within these measures for the implementation of the aims of a court decision executed in a facility and in the case of young adults for easing the process of becoming independent (pocket money, material gifts, contribution for becoming independent, resocialization contribution). measures of financial nature SLPC and SG measures of a financial character are provided to adjust and maintain relationships between child and parent or the person who is personally taking care of him/her and from whom child was removed from care by court decision and for support in the adjusting of their family situation by the state (contributions for food paid in the course of the childs stay at home and during weekends and vacations) and self-administration (contributions to parents for transportation to visit their child in orphanages, financial means for adjusting and renewing of the family situation of the child). These measures are interrelated, that is why they are not understood in a traditional way but as a social service since SLPC and SG measures frequently relate to family intervention. Their goal is to prevent extreme solutions. These measures are adopted in order to use them according to certain situations (school problems, divorce, behavior disorders, drug addiction, criminal activity, release from imprisonment, etc.) when action must be taken or when alternative solutions must be offered under the active participation of the child, parent or adult physical person. For this reason, in Slovakia an orphanage is not a social services facility but an SLPC and SG facility ensuring the execution of a court decision is not understood as a classical social service. Its because of execution of highly professional activities which are not just the provision of food, lodging, etc. SLPC and SG measures are implemented by various types of bodies of the state administration, such as Centre and Offices of Labour, Social Affairs and Family. In compliance with the law, special tasks are implemented by Offices of Labour, Social Affairs and Family, municipalities and higher territorial units. These tasks can also be implemented by accredited legal and physical persons and other physical and legal persons under conditions stipulated by law (a total of 7 subjects with various positions, obligations, etc.). So, mainly these subjects are competent to cooperate and to protect the rights and interests of children and their family. That is why the main targets of the Slovak Republic include improving of the management and good administration on the central, regional and local levels. The following important components are: implementation and monitoring of social protection and social inclusion policies, establishment of partnerships among specific subjects on the horizontal and vertical levels, participation of all interested parties, including the excluded groups. And in the conclusion one good practice is cooperation among the Office of Labour, Social Affairs and Family, facility, municipality and the accredited entities. These subjects create according to the law the plan of social work with the child's family, which comprises monitoring of the mental, physical and social development of the child. Previously mentioned subjects create together the SLPC and SG measures for improving social situation in the natural family of every child with a social problem. The plan takes into consideration specific problems of a family and is based on exact social diagnosis. But it is very important to mention, that successful results of the plan are based on active share of childs family.
